A fiery showdown erupted on Capitol Hill Tuesday as Senators Ted Cruz and Cory Booker locked horns during a heated Judiciary Subcommittee hearing over the rising wave of threats against federal judges — a trend that has spiked dramatically during President Donald Trump’s second term.
The confrontation unfolded during a hearing titled “The Supposedly Least Dangerous Branch: District Judges v. Trump” — a not-so-subtle jab at what Cruz described as growing judicial overreach aimed at obstructing the president’s agenda.
Cruz Draws the Line: “Democrats Were Silent When It Mattered”
Senator Ted Cruz, R-Texas, kicked off the hearing with sharp criticism of Democrats for what he called their “deafening silence” in the face of escalating threats against conservative justices. He blasted Senate Democrats, including Minority Leader Chuck Schumer, for emboldening activists who protested outside the private homes of Supreme Court Justices Brett Kavanaugh and Neil Gorsuch following the historic Dobbs ruling that overturned Roe v. Wade.
“Where was the outrage when mobs gathered at the doors of our highest court’s justices?” Cruz demanded. “Those protests were a direct violation of federal law. Yet not one arrest — not one prosecution — by the Biden DOJ.”
Cruz cited 18 U.S.C. §1507, a law that prohibits picketing near a judge’s residence with the intent to influence decisions. “It’s not just a law on the books,” Cruz said, “it’s a law this administration refuses to enforce.”
Booker Explodes: “That’s a Patent Lie”
Senator Cory Booker, D-N.J., shot back in a loud and emotional outburst, accusing Cruz of spinning a “dangerous falsehood” about Democratic inaction.
“I’m sick and tired of the lies. We condemned those threats,” Booker said, raising his voice. “I remember my colleague Senator Coons speaking out. I remember us working together to pass legislation to protect judges and their families.”
Booker insisted the hearing was being hijacked by “heated partisan rhetoric” and said the real threat came from “a president who drags judges through the mud to rile up supporters.”
“You Didn’t Answer the Question”
Cruz, unfazed, pressed Booker on a single point: “Did the Biden DOJ arrest even one protester under the law? Yes or no?” Booker tried to answer, but Cruz cut him off repeatedly, forcing the New Jersey Democrat to protest the interruptions.
“You don’t want an answer, you want a fight,” Booker retorted.
When Booker refused to directly say whether he supported prosecuting those who violated the judge-protection law, Cruz fired back with a mocking jab: “Let the record reflect that Spartacus didn’t answer the question.”
Why This Matters: Threats on Judges Skyrocket Under Trump’s Agenda
Since President Trump’s second inauguration in January, the U.S. Marshals Service reports a surge in threats against federal judges. More than 370 incidents have been investigated in just five months — on track to shatter last year’s total of 509.
Legal experts point to a growing clash between the judiciary and the White House. Trump’s flurry of executive orders — targeting everything from immigration to digital censorship — have faced coordinated legal resistance, with federal judges in blue districts issuing rapid injunctions that Republicans argue are politically motivated.
Chief Justice John Roberts, typically reserved, even issued a public rebuke last month after Trump labeled one federal judge an “Obama holdover hack.”
More Than Pizza Warnings
Democrats on the panel highlighted a disturbing tactic reportedly used to intimidate judges: the delivery of unsolicited pizzas to their homes — a thinly veiled threat that their location has been doxxed.
“These aren’t pranks,” one Democrat aide told Fox News Digital off the record. “They’re signals — a warning shot to say, ‘We know where you live.’”
Republicans Demand DOJ Accountability
While both parties claim concern for judicial safety, only Republicans appear ready to hold the Department of Justice accountable for what they see as selective enforcement of the law.
“If the DOJ won’t even enforce a clear statute meant to protect our judges,” Cruz said, “what message does that send to the radicals harassing them?”
The hearing ended without resolution — but the tension on display sent one clear message: in the war over America’s judiciary, the gloves are off.
