A federal judge signaled Wednesday that Prince Harry’s immigration records might soon be made public, raising questions about whether the British royal received special treatment when applying for a U.S. visa. If the Duke of Sussex misrepresented his past drug use, as detailed in his own memoir, deportation could be on the table.

Judge Carl J. Nichols of the D.C. District Court addressed the lawsuit filed by the conservative Heritage Foundation, which is demanding the Department of Homeland Security (DHS) release Harry’s visa application. The organization argues that Americans deserve to know if immigration laws were fairly applied or if political favoritism played a role.

“The law requires me to make public everything that can be made public,” Nichols stated in court. He emphasized that any release would need to comply with U.S. privacy regulations but left little doubt that some information would be disclosed.

Did Harry Get Special Treatment?

Harry openly admitted in his 2023 memoir, Spare, to using cocaine, cannabis, and psychedelic mushrooms. Normally, such admissions could make an applicant inadmissible under U.S. immigration law. Waivers are sometimes granted, but the process is strict.

“If he was honest on his application and applied for a waiver, there should be a record of it,” said Samuel Dewey, a lawyer for Heritage. “If he wasn’t truthful, then we have a serious issue.”

Heritage contends that the Biden administration may have quietly allowed Harry into the country without proper vetting. Nile Gardiner, director of Heritage’s Margaret Thatcher Center for Freedom, urged the Trump administration to intervene.

“This isn’t about one individual; it’s about ensuring that our immigration laws are applied fairly,” Gardiner told reporters. “Americans deserve answers.”

Trump’s Take

Former President Donald Trump, now back in the White House, has previously voiced skepticism about Harry’s presence in the U.S. Last year, he told reporters that he would “consider” deporting the prince if it turned out he misled immigration officials.

“He betrayed the Queen, and that’s unforgivable,” Trump said in 2024. “We’ll see what the DHS knows about the drugs. If he lied, they’ll have to take appropriate action.”

The case underscores broader concerns about how elites navigate immigration laws compared to average Americans. As Nichols prepares to make his final decision, the nation waits to see whether the prince will face consequences—or if the system will once again bend for the well-connected.
