President Donald Trump is set to sign a sweeping executive order directing all federal agencies to identify and enforce laws against antisemitism, with a particular focus on deporting non-citizens involved in anti-Jewish activities, The Post has learned.
The order, expected Wednesday, instructs the Justice Department and Homeland Security to investigate and take action against foreign nationals engaged in antisemitic protests, including those on student visas. Agencies have 60 days to submit recommendations, per an internal document reviewed by The Post.
“The United States will not be a breeding ground for hate,” a senior White House official told The Post. “If you break our laws to promote violent antisemitism, you will face the consequences—including deportation.”
Deportation on the Table for Visa Holders
The executive order directly targets resident aliens who have participated in anti-Israel demonstrations since the October 7, 2023, Hamas-led terrorist attack against Israel, which left 1,200 dead. The White House directive follows mounting concerns over increasing hostility against Jewish communities on American soil.
“We’re seeing radicalized students, many of them foreign nationals, openly calling for the destruction of Israel and celebrating Hamas terrorists,” said Rep. Elise Stefanik (R-NY), a close Trump ally and nominee for U.S. Ambassador to the UN. “This is not about free speech. It’s about protecting American values and Jewish students who are being harassed on their own campuses.”
Colleges Under Scrutiny
The move follows a December 2024 House GOP report that slammed elite universities for failing to combat antisemitism on campus, particularly Columbia University, where an encampment featured documented instances of anti-Jewish harassment. That report revealed that institutions allegedly tolerating such behavior received $2.7 billion in federal funding in 2023.
House Republicans argue that current civil rights laws should be leveraged to cut off taxpayer money to universities that fail to act against antisemitic behavior.
“These schools cannot continue to take billions from the federal government while allowing hate to fester,” said Rep. Jim Jordan (R-OH), who led the committee’s investigation.
Legal Precedent for Tougher Action
Historically, courts have upheld the government’s authority to deny entry and deport non-citizens based on political activity. The 1972 Kleindienst v. Mandel case allowed visa denial to a Belgian Marxist, setting precedent for barring or expelling individuals whose speech or actions threaten public order. More recently, in 2020, Trump sought to defund New York City, Portland, and Seattle over their response to violent protests.
Biden Administration Blocked Visa Data Requests
The House report also revealed that the State Department and Department of Homeland Security under President Joe Biden refused to release records regarding visa holders involved in anti-Israel protests. This has fueled Republican accusations that the previous administration was complicit in allowing dangerous foreign actors to operate within the U.S.
“The Biden administration covered up for radicals who chanted ‘Death to Israel’ on American soil,” said Sen. Tom Cotton (R-AR). “President Trump is restoring law and order and ensuring that antisemitism has real consequences.”
The Political and Cultural Battle Over Antisemitism
Trump’s decisive action follows a series of high-profile antisemitic incidents across the U.S., including in Washington, D.C., where activists carried banners supporting Hamas during Israeli Prime Minister Benjamin Netanyahu’s July 2024 address to Congress. In Richmond, Virginia, Zaid Mohammed Mahdawi, 26, was arrested for defacing federal property with the words “HAMAS IS COMIN’”—an act Trump officials cite as proof of rising extremism.
As Trump prepares for a likely November rematch with Joe Biden, his administration is making it clear: antisemitism will be met with swift and severe action. “America stands with Israel. We will not tolerate hate,” Trump declared in a recent rally.
The order is expected to take immediate effect upon signing, with enforcement actions following in the coming months.
